When we say “Company”, “we”, “our”, or “us” in this document, we are referring to Kaitenji LLC.

When we say “Services”, we mean any product created and maintained by Kaitenji LLC, whether delivered within a web browser, desktop application, mobile application, or another format.

When we say “You” or “your”, we are referring to the people or organizations that own an account with one or more of our Services.

We may update these Terms of Service ("Terms") at any time. By using our Services, now or in the future, you agree to the latest version of these Terms. Even if we do not enforce a provision, it does not mean we waive it. These Terms include a limitation of our liability.

If you violate any of the Terms, we may terminate your account.

Account Responsibilities

  1. You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  2. You are responsible for all content posted to and activity that occurs under your account, including content posted by and activity of any users in your account.
  3. You must be a human. Accounts registered by “bots” or other automated methods are not permitted.

Uptime, Security, and Privacy

  1. Your use of the Services is at your sole risk. We provide the Services on an “as is” and “as available” basis. No service-level agreements are offered.
  2. We reserve the right to temporarily disable your account if your usage significantly exceeds that of other customers. We will contact the account owner before taking action, except in rare cases where the level of use negatively impacts other customers.
  3. We take measures to protect and secure your data through backups, redundancies, and encryption.
  4. When using our Services, you entrust us with your data. We process your data as described in our Privacy Policy, and for no other purpose. We may access your data in the following cases:
    • Support requests: We ask for consent before accessing your account.
    • Error handling: We fix errors stopping automated processes and, in rare cases, must view personal data to do so.
    • Security: We may view logs and metadata to safeguard your data and our Services.
    • Legal compliance: We comply with U.S. law when sharing or preserving customer data.
  5. We use third-party vendors and hosting partners for hardware, software, networking, and storage needed to run the Services.
  6. Under the California Consumer Privacy Act (“CCPA”), Kaitenji is a “service provider”, not a “business” or “third party” concerning your use of the Services.

Copyright and Content Ownership

  1. All content posted on the Services must comply with U.S. copyright law.
  2. You grant us a limited license to use your content to provide the Services, but you retain ownership of that content.
  3. We do not pre-screen content but reserve the right to remove any content at our sole discretion.
  4. The Company owns all rights to the Services, including intellectual property. You may not duplicate or reuse any part of the Services without written permission.

Features and Bugs

We design our Services based on our experience and customer feedback. However, there is no guarantee that they will meet your expectations. As with any software, bugs are inevitable. We prioritize security or privacy-related issues, but not all bugs will be fixed.

Liability

You expressly understand and agree that the Company is not liable for any damages resulting from the use of the Services, including lost profits, unauthorized access, or any other matter relating to these Terms or the Services.
